Our Experience
We initially became involved with delinquent assessment collections by representing associations that had been sued or threatened with a lawsuit based on mistakes allegedly made by a collection company. Community associations were requesting our legal services whenever a homeowner challenged an action taken by a collection company. We also had community associations asking for legal assistance when collection companies were unable to deal with legal threats from other parties claiming an interest in the property, when collection companies were unable to appear in State court when a homeowner filed a lawsuit, when collection companies were unable to provide legal opinions regarding certain issues, and when collection companies were unable to bring a motion in bankruptcy court to compel payments by homeowners.
So, we initially were retained to handle the more difficult cases involving delinquent assessment collections. In particular, cases where a collection company was unable to collect the funds for an association and where the collection company had taken all of the action it was legally able to take, such as when a homeowner filed a lawsuit or when there was some legal proceeding. Our clients began requesting that we handle all of their delinquent assessment collection files. We found that associations needed the same professional legal services for delinquent assessment collections as with other legal issues facing community associations.
For many years now we have handled the entire collection process for community associations throughout Nevada. We have found that by handling the process from the beginning, we are able to avoid some of the problems we originally saw occurring.
