Opinion Letters

We have written thousands of legal opinions for our clients over the years. The purpose of an opinion letter is two-fold. First, an opinion letter provides legal guidance to a board of directors when making decisions. Second, an opinion letter provides protection to board members and an association.

Under Nevada law, a board member is entitled to rely on information provided by experts. Further, where a board member relies on legal advice, a board member will generally be shielded from liability. Equally importantly, sound legal advice can keep your association out of legal trouble, ensure your contracts protect the association, resolve disputes with homeowners and vendors, and provide answers to legal issues that periodically arise.

As a board member, if you are asked to make a decision that involves any legal issue or where you are concerned that a legal dispute over the decision might arise, it would be wise to request a written legal opinion from your association's legal counsel.
