American's with Disabilities Act

Remember, any time a person requests a particular accommodation from your association, you need to be aware that the situation could be covered by the Federal Americans with Disabilities Act. This means that the Association may be required to make reasonable accommodations for a person with a disability. There are thousands of cases interpreting the American's with Disabilities Act and every case depends on the specific facts. It is important for your association to be aware that under certain circumstances it may be required to make accommodations for persons with disabilities. If you are unsure as to whether your association has an obligation to make accommodations in a particular instance, what constitutes a "reasonable accommodation" in a particular case, and who is responsible to pay the cost of such accommodation, we will provide a written opinion addressing the matter.
